This thesis investigates the degree of uniformity in the implementation of Regulation (EU) 2020/1503 on European Crowdfunding Service Providers (ECSPs), aiming to determine whether its application across the Member States of the European Union is effectively harmonized or whether regulatory and operational divergences persist that hinder the creation of a fully integrated European crowdfunding market. The research adopts an integrated methodological approach, combining documentary, empirical, and quantitative analyses. Following a reconstruction of the theoretical and regulatory framework, a structured questionnaire was administered to a sample of platforms authorized as ECSPs, in order to collect both qualitative and quantitative data concerning operational practices and relationships with national supervisory authorities. Based on the responses, a scoring model was developed to quantify and compare the regulatory and administrative burdens across different countries. The findings reveal significant heterogeneity in the interpretation and enforcement of the Regulation. Italy and France exhibit the highest levels of regulatory stringency, while countries such as Ireland and Denmark adopt more flexible and proportionate supervisory approaches. However, the analysis does not identify a direct correlation between regulatory rigidity and market development: the most stringent frameworks often correspond to more mature, transparent, and institutionally credible markets. The study concludes that European harmonization should be understood as a dynamic and evolutionary process, driven by institutional cooperation, proportionality, and convergence of supervisory practices rather than mere formal uniformity. The long- term effectiveness of Regulation (EU) 2020/1503 will depend on the capacity of iii European and national authorities to ensure consistent, transparent, and innovation- oriented implementation, fostering the sustainable development of the European capital market.
La presente tesi analizza il grado di uniformità nell’applicazione del Regolamento (UE) 2020/1503 relativo ai fornitori europei di servizi di crowdfunding (ECSP), con l’obiettivo di valutare se tale normativa venga interpretata e attuata in modo omogeneo all’interno degli Stati membri dell’Unione Europea o se persistano differenze di natura regolamentare e operativa che ostacolano la piena armonizzazione del mercato europeo del crowdfunding. La ricerca adotta un approccio integrato, combinando analisi documentale, indagine empirica e modellizzazione quantitativa. Dopo una ricognizione del quadro teorico e normativo di riferimento, è stato somministrato un questionario strutturato a un campione di piattaforme autorizzate come ECSP, volto a raccogliere dati qualitativi e quantitativi sulle pratiche operative e sui rapporti con le autorità di vigilanza nazionali. Sulla base delle informazioni raccolte è stato sviluppato un modello di punteggio (scoring model) per misurare, su scala comparabile, il grado di complessità e onerosità regolamentare nei diversi Paesi europei. I risultati evidenziano una eterogeneità significativa nell’applicazione del Regolamento. L’Italia e la Francia presentano i livelli più elevati di rigidità normativa, mentre paesi come Irlanda e Danimarca adottano approcci più flessibili e proporzionati. Tuttavia, non emerge una correlazione lineare tra severità regolatoria e sviluppo del mercato: i contesti più rigorosi risultano spesso anche i più maturi e affidabili. i Le conclusioni sottolineano come l’armonizzazione europea costituisca un processo dinamico più che un traguardo raggiunto, fondato su cooperazione istituzionale, proporzionalità e convergenza delle pratiche di vigilanza. L’efficacia del Regolamento dipenderà, nel lungo periodo, dalla capacità delle autorità europee e nazionali di applicarlo in modo coerente, trasparente e orientato alla crescita sostenibile del mercato dei capitali.
