Il regolamento edilizio. Ruolo e prospettive di riforma con particolare attenzione alla regione Lombardia

The interest in regulatory apparatus on which the planning instruments are based made me want to know more about an instrument based on a system of abstract and general rules such as the Regolamento Edilizio Comunale, particularly in the case of Lombardy Region. I believe that a good knowledge of the legal system and the functioning of the rules and the law is a fundamental element for a future engagement work in the area urban planning. Consider a planning tool based on a system of rules means understanding its form, structure, components and especially issues arising act application and its relationship with the other instruments. The coexistence of planning instruments, whose roles and responsibilities are often intertwined, thin the line between one and the other. The analysis of this instrument, whose function has changed much in the last century, is designed to find out what its real function today and its relationship with the general planning instrument, which seems to absorb more and more of its tasks. What is now the Regolamento Edilizio? What is its function within the municipal planning regulations? What problems occur? We will try to answer these questions through the analysis of this instrument from the point of view of the theory and practice through the study of its history, its consideration by the regulatory apparatus and through the analysis of case studies in order to define a precise profile and find out if refers to a functional tool, or if it is the case to take into account a series of integrations which favor the relationship with the plan and that it would clarify the contents.

L’interesse nei confronti dell’apparato normativo su cui si fondano gli strumenti urbanistici mi ha spinto a voler approfondire l’argomento considerando di analizzare uno strumento fondato su un sistema di norme astratte e generali come il Regolamento Edilizio Comunale, in particolare per il caso della Regione Lombardia. Ritengo che la buona conoscenza del sistema legislativo ed il funzionamento delle norme e del diritto sia un elemento fondamentale per un futuro impegno lavorativo nel settore del governo del territorio. Considerare uno strumento urbanistico fondato su un sistema di norme significa comprenderne la forma, la struttura, le componenti e soprattutto le questioni che scaturiscono dall’atto applicativo e la sua relazione con gli altri strumenti. La compresenza di strumenti urbanistici, i cui ruoli e competenze spesso si intrecciano, assottiglia la linea di confine tra uno e l’altro. L’analisi di questo strumento, la cui funzione è variata molto nell’ultimo secolo, ha lo scopo di scoprire quale sia la sua reale funzione oggi ed il suo rapporto con lo strumento urbanistico generale, il quale sembra assorbire sempre maggiormente le sue funzioni. Cosa rappresenta oggi il Regolamento Edilizio? Quale è la sua funzione all’interno della disciplina urbanistica comunale? Quali problematiche presenta? Cercheremo quindi di dare una risposta a queste domande attraverso l’analisi di questo strumento dal punto di vista della teoria e della pratica, attraverso lo studio della sua storia, della considerazione da parte dell’apparato normativo ed attraverso l’analisi di alcuni casi studio in modo da definirne un profilo preciso e scoprire se fa riferimento ad uno strumento funzionale oppure se è il caso di prendere in considerazione una serie di integrazioni che ne favoriscano il rapporto con il piano e che ne chiarifichino i contenuti.
